Last updated: May 2026 | These terms apply to all users of WhaWallet, including
group admins, contributors, and withdrawal recipients.
1. About WhaWallet
WhaWallet ("we", "us", "the Service") is a WhatsApp-based group treasurer assistant operated by Whawallet Investment Group, Nairobi, Kenya. The Service allows WhatsApp group administrators to collect M-Pesa contributions
from group members, track balances in real time, and initiate withdrawals to M-Pesa, Till Numbers, or
Paybill accounts.
By registering a WhatsApp group, making a contribution, or initiating a withdrawal through WhaWallet, you
agree to be bound by these Terms & Conditions and our Privacy Policy.
2. Eligibility
- You must be at least 18 years old to use WhaWallet.
- You must be a registered M-Pesa user with a valid Kenyan phone number.
- Group admins must be the verified administrator of the WhatsApp group they register.
- WhaWallet is currently available to users in Kenya only.
3. Service Fee & Fee Structure
How fees work: A service fee of
1.5% is charged to the
contributor at the time of payment — not to the group admin or the group pot.
- 1.0% covers the standard Safaricom M-Pesa transaction cost (passed through at
cost).
- 0.5% is WhaWallet's service fee.
The group administrator withdraws
100% of the total contributions collected — no deductions
are made at withdrawal.
Example: A contributor sending KES 1,000 will be charged KES 1,015. The group pot receives KES 1,000.
WhaWallet retains KES 5.
Fees are subject to change. We will notify registered group admins of any changes at least 14 days in advance
via WhatsApp or email.
4. Group Admin Responsibilities
By registering a WhatsApp group on WhaWallet, the group admin agrees to:
- Use the Service only for lawful fundraising and contribution purposes.
- Accurately represent the purpose of the fundraising drive to group members.
- Disburse collected funds in accordance with the stated purpose communicated to contributors.
- Not use WhaWallet to collect funds for illegal activities, gambling, fraud, or any purpose that violates
Kenyan law.
- Maintain administrative control of the registered WhatsApp group and not transfer the withdrawal link to
unauthorised parties.
- Take full responsibility for all withdrawals initiated under their account.
5. Contributions
- All contributions are processed via Safaricom M-Pesa and are subject to M-Pesa's own terms and
availability.
- Contributions are non-refundable once processed, unless the group admin initiates a
return and a refund is technically feasible.
- WhaWallet does not guarantee the delivery of funds to any particular end use — that is the
responsibility of the group admin.
- Contributors should satisfy themselves that they trust the group admin before contributing.
Important: WhaWallet is a payment collection and tracking tool. We do not vet the
legitimacy of fundraising campaigns. Always contribute only to groups and admins you personally trust.
6. Withdrawals
- Only the group admin who originally registered the group may initiate a withdrawal.
- Withdrawals are processed to the M-Pesa number, Till Number, or Paybill specified by the admin.
- WhaWallet processes withdrawals within the timeframes permitted by our payment providers. We are not
liable for delays caused by Safaricom, banks, or third-party payment processors.
- Minimum and maximum withdrawal limits may apply and will be communicated within the withdrawal
interface.
- All withdrawals are logged and a record is posted to the WhatsApp group for transparency.
7. Prohibited Uses
You may not use WhaWallet to:
- Collect funds fraudulently or under false pretences.
- Launder money or facilitate any financial crime.
- Collect funds for political campaigns without the required regulatory approvals.
- Impersonate another person, organisation, or legitimate fundraising cause.
- Attempt to hack, reverse-engineer, or disrupt the WhaWallet platform or WhatsApp's systems.
- Register the same group multiple times to circumvent limits or fees.
We reserve the right to suspend or terminate any account or group registration found in violation of these
terms, without prior notice, and to report suspected fraud to the relevant Kenyan authorities.
8. Limitation of Liability
WhaWallet provides the Service on an "as is" and "as available" basis. To the maximum extent permitted by
Kenyan law:
- We are not liable for any loss of funds resulting from fraud by a group admin or third party.
- We are not liable for service interruptions caused by WhatsApp, Safaricom, or internet outages.
- Our total liability to any user for any claim shall not exceed the total service fees paid by that user
in the 3 months preceding the claim.
- We are not liable for indirect, consequential, or punitive damages of any kind.
9. Intellectual Property
All content, branding, code, and materials on the WhaWallet platform are the property of Whawallet Investment Group. You
may not reproduce, distribute, or create derivative works without our written consent. WhaWallet is not
affiliated with, endorsed by, or in partnership with WhatsApp, Meta, or Safaricom.
10. Privacy
Your use of WhaWallet is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal
data in accordance with the Kenya Data Protection Act 2019.
11. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted at this URL with a revised
"Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.
12. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from the use of WhaWallet
shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to the
jurisdiction of the Kenyan courts.
